The 28th Amendment: The right to affordable healthcare and health care insurance

We propose an amendment to protect the American citizen’s right to affordable health care.

“Congress shall make no law abridging the right to obtain health care or health care insurance, or imposing a tax or other penalty for the failure to obtain health care or health care insurance.”

Such an amendment will secure the right that the Americans have, under the ninth and tenth amendments, under the clauses covering all privileges kept by free people in 1789 or later. However, a new amendment is required because the political class has failed to accept the right to affordable healthcare.

        A right is an aspect of life in which the government cannot intervene. For example, the Freedom of Religion protected by the First Amendment prohibits the federal government from either establishing a religion or prohibiting the free exercise of religion. The amendment applies to Congress doing so, but note that, under the Constitution, only Congress may pass new legislation, so the clause relates to a specific restriction against the development of any legislation by the federal government. Much as the right to freedom of worship does not compel the government: the taxpayers, to buy you a church. A right is an aspect of life in which the government cannot intervene.            The United States of America doesn’t really have a health care system, only a health insurance system. This system is designed to deny rather than support the right to health. Having affordable health care would not only help Americans individually but also as a whole. Not only could it possibly better a person’s health and way of living but it could also help the economy. Establishing a right to healthcare would lower the overall cost of healthcare in the United States. allowing even the poorest of people to medical services. It could prevent future social issues. Early childhood care or early detection of certain health issues could lower welfare dependency and even possibly crime.

         The right to health insurance does not oblige the government to acquire health treatment for you. Instead, the freedom to health coverage ensures that you will access health services or life benefits in whatever manner you choose without the intervention of the government.
