Using I-797 Approval Notice to Begin OPT Employment

    F-1 Students with Pending OPT Applications:

     

    Due to delays in the production of EAD’s (OPT cards), USCIS has announced a COVID-19 accommodation regarding the start of OPT.

     

    Normally, a student must wait until they have received the EAD until they can begin their OPT employment.  USCIS has announced that students with an approved OPT application who have received an I-797 Notice of Action, notifying them of their OPT approval, are allowed to use the I-797 as a List “C” document in the I-9 process.

     

    This will allow students to begin their OPT on the start date indicated on the I-797, even if they have not received the EAD.
